Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ToyVerse ("ToyVerse", "we", "us", or "our"), a company incorporated under the laws of India with its registered office in Amritsar, Punjab, India.

By accessing or using toyverse.in — including browsing our website, creating an account, placing an order, submitting a review, or using any ToyVerse service — you confirm that you have read, understood, and agree to be bound by these Terms and all policies incorporated by reference, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree to these Terms, please do not use our website or services. Continued use of ToyVerse following any modification to these Terms constitutes acceptance of the updated Terms.

These Terms were last updated on March 21, 2026 and are effective immediately. They supersede all prior versions.

Key Definitions

Throughout these Terms, the following words and phrases carry the meanings defined below:

"Platform"

The ToyVerse website (toyverse.in), mobile application, and all associated digital services, APIs, and tools operated by ToyVerse

"User"

Any individual who accesses, browses, registers on, or transacts on the Platform, whether as a guest or registered account holder.

"Account"

A registered profile created by a User on the Platform, secured with a username and password, enabling order placement and account management.

"Products"

All physical goods (toys, games, books, art supplies, gift cards, and related items) listed for sale on the Platform by ToyVerse.

"Order"

A confirmed purchase request submitted by a User for one or more Products, resulting in a binding contract of sale upon acceptance by ToyVerse.

"Content"

All text, images, videos, reviews, product descriptions, logos, branding, and other material available on or submitted to the Platform.

"User Content"

Content created and submitted by Users, including product reviews, ratings, photos, comments, and support messages.

"Services"

All features and functions offered via the Platform, including product discovery, order management, customer support, and marketing communications.

User Eligibility

To use ToyVerse's services and place orders, you must meet the following eligibility criteria:

✅ You must be at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is higher.
✅ If you are between 13 and 18 years old, you may use the Platform only with the explicit consent and active supervision of a parent or legal guardian who agrees to these Terms on your behalf.
✅ You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872.
✅ You must have a valid email address and mobile number for account registration and order communications.
✅ You must be a resident of India or have a valid Indian delivery address to place orders (international shipping is not currently available).

If you do not meet these criteria, you are not authorised to create an account or place orders on ToyVerse. Creating an account with false information or on behalf of someone who does not meet eligibility requirements is a violation of these Terms and may result in account suspension and cancellation of any pending orders.

User Accounts & Registration

While you may browse ToyVerse as a guest, placing orders requires a registered account. Here's what you need to know about account creation and management:

You must provide truthful, current, and complete information during registration and keep it updated. False information may result in order cancellation.

Account Security

You are responsible for maintaining the confidentiality of your password and all activities that occur under your account. Use a strong, unique password.

One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent policies or exploit promotions is prohibited.

Report Unauthorised Access

Notify us immediately at security@toyverse.in if you suspect unauthorised access to your account. We are not liable for losses due to compromised credentials.

ToyVerse will never ask for your password via email, phone, or WhatsApp. If you receive such a request, it is fraudulent — do not respond and report it to us immediately.

ToyVerse reserves the right to suspend, restrict, or terminate any account at its sole discretion if it determines that the account has been used in violation of these Terms, applicable law, or in a manner harmful to other users or our business.

Products, Listings & Availability

Our authenticity guarantee: Every product listed and sold on ToyVerse is 100% original, brand-new, and sourced directly from authorised brand distributors or official importers. We do not list used, refurbished, grey-market, or counterfeit products under any circumstances.

📸 Product images on ToyVerse are representative of the actual products. Colour and size may vary marginally due to photography and screen calibration.
📦 Product availability is subject to stock levels. We do not guarantee continuous availability of any listed product.
✏️ Product descriptions, specifications, and pricing are subject to change without notice. We strive for accuracy but do not warrant that all information is error-free.
🚫 In the event of a material product description error (e.g., wrong price due to technical glitch), ToyVerse reserves the right to cancel the affected orders and provide a full refund.
📋 All products comply with applicable Indian safety standards including BIS certifications where mandated. Age recommendations on product listings are provided as guidelines from brand manufacturers.

Product safety warnings and age recommendations must be followed. ToyVerse is not liable for injuries or harm resulting from misuse, failure to follow product instructions, or use by children outside the recommended age range.

Section 06

Orders, Checkout & Payments

Placing an order on ToyVerse creates a binding transaction subject to our acceptance. Here's the complete order flow and your rights at each stage:

Order Placement

Adding a product to your cart and completing checkout constitutes an offer to purchase. Your order is not confirmed until you receive an Order Confirmation email from ToyVerse.

Payment Processing

All payments are processed by our secure payment gateway partners (Razorpay / PayU / Stripe). ToyVerse does not store your payment card details. Accepted methods: Credit/Debit Cards, UPI, Net Banking, Wallets, and Cash on Delivery (select pin codes).

Order Acceptance

ToyVerse reserves the right to refuse or cancel any order at any time before dispatch, including orders for products that are out of stock, incorrectly priced, or involve suspected fraudulent activity. A full refund will be processed in such cases.

Contract of Sale

A legally binding contract of sale is formed between you and ToyVerse only upon dispatch of your order. The contract is governed by these Terms and Indian consumer protection law.

Invoice & GST

A GST-compliant invoice is automatically generated and emailed to you upon order confirmation. Physical invoices are included with each shipment. Keep this for warranty claims and returns.

Failed payment transactions due to bank declines, insufficient funds, or network errors are not ToyVerse's responsibility. Your order will not be placed until payment is successfully confirmed. Contact your bank or payment provider if you face persistent issues.

Pricing, Taxes & GST

All prices are at or below MRP. We never charge above the Maximum Retail Price set by the brand.

GST Inclusive

Displayed prices include applicable GST. No taxes are added at checkout beyond what's shown on product pages.

Free Shipping Always

No delivery charge is added to any order. Express delivery is optional and priced separately.

GST Benefit

ToyVerse passes 10% of GST benefit to customers at checkout where applicable under our promotional scheme.

Price Changes

Prices may change at any time. The price you pay is locked at the moment of order placement and shown on your invoice.

Promotional Prices

Discount codes, sale prices, and promotional rates are time-limited and subject to specific terms stated at the time of offer.

ToyVerse issues GST-compliant tax invoices for all orders. Our GSTIN: 03XXXXX1234X1ZX. Prices are in Indian Rupees (₹) only. ToyVerse does not accept foreign currency payments.

Promotional coupons and discount codes can only be applied at checkout before payment. Discounts cannot be applied retroactively to confirmed orders. Each coupon may have a single-use or limited-use restriction as specified in its terms.

User Conduct & Prohibited Activities

ToyVerse is a platform built on trust, for families and parents. We expect all users to engage with our platform in a respectful, lawful, and good-faith manner.

✔ Browsing, searching, and purchasing products for personal or gift use
✔ Creating a legitimate account with your real information
✔ Writing honest, constructive product reviews
✔ Contacting support for genuine order queries or assistance
✔ Sharing product links or wishlists with others
✔ Using legitimate discount codes issued by ToyVerse

❌ Prohibited Activities

✗ Placing fraudulent orders, using stolen payment methods
✗ Creating fake accounts or impersonating others
✗ Scraping, crawling, or bulk-extracting website data
✗ Attempting to hack, breach, or exploit our systems
✗ Submitting false, defamatory, or misleading reviews
✗ Abusing return/refund policies repeatedly or fraudulently
✗ Reselling ToyVerse products commercially without our written consent
✗ Using bots or automated tools to place orders

Violation of prohibited activity rules may result in immediate account suspension, cancellation of pending orders, forfeiture of credits or promotions, and may be reported to law enforcement authorities where applicable. ToyVerse reserves the right to pursue legal remedies for material violations.

Intellectual Property Rights

All content on the ToyVerse Platform — including but not limited to the logo, brand name, website design, typography, product descriptions, photography, illustrations, and underlying code — is the exclusive intellectual property of ToyVerse or is licensed to us by the respective rights holders.

📸 Product images and descriptions belong to ToyVerse or their respective brands. They may not be used for commercial purposes without permission.
🔗 Linking to our website is permitted for non-commercial, informational purposes. Deep-linking or framing our website without permission is prohibited.
🤖 Automated scraping or harvesting of our content for any purpose is strictly prohibited and may constitute a violation of the IT Act, 2000.

Brand names (LEGO, Skillmatics, Crayola, etc.) and their respective trademarks/logos appearing on ToyVerse belong to their respective owners. ToyVerse uses them solely to identify the products it sells as an authorised retailer.

Section 10

Product Reviews & User Content

We welcome and encourage honest, detailed product reviews from verified buyers — they help the ToyVerse community make better decisions. By submitting a review or any User Content, you agree to the following:

✅ Reviews must be based on your genuine, first-hand experience with the product.
📜 By submitting content, you grant ToyVerse a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and share your content on our platform and in marketing materials.
✅ You retain ownership of your content but confirm it does not infringe any third-party rights.
🚫 Reviews must not contain defamatory, hateful, obscene, or personally identifying information about others.
🚫 Paid or incentivised reviews without disclosure, and fake reviews, are strictly prohibited.
🗑️ ToyVerse reserves the right to edit, remove, or refuse to publish any User Content that violates these Terms or our community standards.

ToyVerse uses verified purchase reviews only for our star ratings displayed on product pages. We do not filter or suppress negative reviews. Authenticity is central to our community.

Section 11

Limitation of Liability

To the maximum extent permitted under applicable Indian law, ToyVerse's liability to you in connection with our services is limited as follows:

Indirect / consequential losses	ToyVerse is not liable for indirect, consequential, or punitive damages in any scenario
Maximum aggregate liability	Limited to the value of the specific order giving rise to the claim

Nothing in these Terms excludes or limits ToyVerse's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under the Consumer Protection Act, 2019.

Disclaimers & Warranties

While ToyVerse strives to provide an exceptional shopping experience, the Platform and its services are provided "as is" and "as available" with the following disclaimers:

📌 We do not warrant that product descriptions, prices, or availability information will always be accurate, complete, or current.
📌 Reviews and ratings reflect individual user experiences and do not constitute endorsements or warranties by ToyVerse.
📌 Advice or recommendations provided by our customer support team regarding product suitability are offered in good faith as general guidance only and do not constitute professional advice.

Despite the above standard disclaimers, ToyVerse does maintain an explicit guarantee of product authenticity for all items sold. If you receive a counterfeit product, we offer a full refund and will take appropriate action with our supply chain.

Section 13

Account Termination & Suspension

Both ToyVerse and you have the right to end the relationship governed by these Terms:

You Can Close Your Account

You may close your account at any time by contacting us at support@toyverse.in. Pending orders will be fulfilled or refunded first. Data deletion follows our Privacy Policy.

ToyVerse Can Suspend Accounts

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or create risk or legal exposure for ToyVerse or other users.

📦 Orders placed before termination that are already in transit will be fulfilled normally.
💰 Any outstanding refunds owed to you will be processed within 7–10 business days of account closure.
🎁 Unused store credits, wishlist items, and loyalty points are forfeited upon account termination for policy violations.
📜 Sections of these Terms that by their nature should survive termination (intellectual property, liability limitations, dispute resolution) will continue to apply after account closure.

Dispute Resolution & Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or related to these Terms or your use of ToyVerse shall be subject to the exclusive jurisdiction of the courts of Amritsar, Punjab, India.

Dispute Resolution Process:

Informal Resolution (First)

Before pursuing formal legal action, both parties agree to attempt good-faith resolution. Contact our Grievance Officer at grievances@toyverse.in with a detailed description of your complaint. We will respond within 15 business days.

Consumer Forum (For Consumers)

If informal resolution fails, individual consumers may escalate to the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019. We fully support your rights under this legislation.

Arbitration (For Commercial Disputes)

For non-consumer commercial disputes, both parties agree to resolve disputes through binding arbitration in Amritsar under the Arbitration and Conciliation Act, 1996, before resorting to litigation.

Any claim or cause of action arising from your use of ToyVerse must be filed within one (1) year after the event giving rise to the claim, or it will be forever barred, to the extent permitted by applicable law.

Changes to These Terms

ToyVerse reserves the right to modify these Terms at any time. Our commitment to you on how we handle updates:

📧 For material changes that significantly affect your rights or obligations, we will notify you by email at least 14 days in advance.

They supersede all prior communications, representations, and agreements on these subjects.

If any provision of these Terms is held to be unenforceable or invalid under applicable law, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
